Delhi High Court Rejects Sameer Wankhede’s Defamation Plea Over Aryan Khan’s Netflix Series

The court found the Delhi filing not maintainable for want of jurisdiction, leaving the show available on Netflix.

Overview

  • Former NCB officer Sameer Wankhede sued over The Ba***ds of Bollywood seeking a permanent injunction, a declaration, and Rs 2 crore in damages to be donated to Tata Memorial Cancer Hospital.
  • The suit names Red Chillies Entertainment, Netflix and intermediaries including X, Google and Meta, with a request to restrain the series’ streaming and distribution.
  • Wankhede alleges a character closely resembles him and cites a scene showing a middle finger after “Satyamev Jayate” as insulting the national emblem under the Prevention of Insults to National Honour Act, 1971.
  • Justice Purushaindra Kumar Kaurav told Wankhede’s counsel the plaint was not maintainable and flagged jurisdictional pleading defects under Section 9 of the CPC, noting any amended filing would be listed by the registry.
  • Released on September 18 as Aryan Khan’s directorial debut, the series remains online as Wankhede argues it falsely maligns him and anti-drug agencies while related matters continue in Mumbai courts.
