Delhi High Court Questions Centre’s Authority to Order Cuts in Udaipur Files

  • On July 30 a bench of Chief Justice Devendra Kumar Upadhyaya and Justice Tushar Rao Gedela asked the Centre if Section 6(2) of the Cinematograph Act empowers it to direct six additional cuts to Udaipur Files.
  • The government approved the film’s release on July 21 after a review panel imposed six new edits on top of 55 cuts suggested by the CBFC and required a revised disclaimer.
  • Petitioners including Mohammed Javed, an accused in the Kanhaiya Lal murder trial, and Maulana Arshad Madani contend the film’s release could prejudice the ongoing NIA trial and inflame communal tensions.
  • The Supreme Court on July 24 declined to extend its stay and remanded challenges back to the Delhi High Court to assess the Centre’s revisional order.
  • The High Court has adjourned further arguments to August 1 for the Centre to justify its exercise of revisional powers before the film can be released.
