Delhi High Court Quashes NHAI Rule Making CLAT-PG Scores the Sole Basis for Hiring Lawyers

The bench ruled the postgraduate law test lacks a rational nexus to job suitability in public service.

Overview

  • A division bench of Chief Justice D.K. Upadhyaya and Justice T.R. Gedela allowed a PIL and set aside NHAI’s August 11 notification restricting eligibility to CLAT-PG scorers.
  • The court held the criterion arbitrary and constitutionally infirm under Articles 14 and 16 for lacking a logical link to the object of recruitment.
  • The notification confined applications to those who took CLAT-PG from 2022 onward, excluding otherwise qualified law graduates and practising advocates.
  • NHAI had defended CLAT-PG as an objective proxy for legal acumen and said experience was also weighed, but the bench rejected that justification.
  • Hiring for 44 young professional (legal) posts remains on hold, and the detailed written judgment is awaited after an interim stay issued on September 18.
