Delhi High Court Quashes 2016 Tax Reassessment Notices to NDTV Founders, Orders ₹2 Lakh Costs

The bench held that reopening completed assessments on the same issues amounted to a prohibited change of opinion.

Overview

  • A Division Bench of Justices Dinesh Mehta and Vinok Kumar set aside the March 31, 2016 notices to Prannoy and Radhika Roy.
  • All proceedings flowing from those notices were nullified, with the Income Tax Department directed to pay ₹1 lakh to each petitioner.
  • The notices concerned alleged interest-free loans to promoter entity RRPR Holding Pvt. Ltd. that had already been examined in an earlier cycle.
  • The Roys challenged the second reopening in November 2017 after a prior reopening in 2011 culminated in a reassessment order in March 2013.
  • The court’s order comes as parallel RRPR proceedings continue, including a September 2024 quashing of a notice and other matters under stay.
