Delhi High Court Orders DUSIB to Turn Hospital Subways Into Emergency Night Shelters

The bench cast the crisis as a constitutional duty requiring rapid, coordinated relief.

Overview

  • DUSIB was directed to immediately take charge of subways near AIIMS, Safdarjung, RML and Lady Hardinge and install beds, winterised tents and basic amenities.
  • A 10 am Thursday meeting led by the Principal District Judge (South) will finalize a short-term plan for same-day execution, with the judge’s decision binding.
  • The court impleaded key hospitals and civic agencies including MCD, NDMC, DMRC, DDA, PWD, DJB, L&DO and Delhi Police, and added the Centre for Holistic Development as an intervenor.
  • Central government counsels reported an urgent shortfall of about 400 beds near AIIMS and Safdarjung, while AIIMS raised security concerns and claimed existing measures suffice, and intervenors filed late-night photos showing ongoing need.
  • The bench said denying shelter violates fundamental rights, warned non-cooperating officials of accountability, sought compliance reports and long-term proposals, and listed the case for January 16.
