Overview

  • On July 15, the Delhi High Court dismissed Arsalan Feroze Ahenger’s bail plea, upholding a September 2024 order and citing his influence and potential to tamper with evidence.
  • A division bench of Justices Subramonium Prasad and Harish Vaidyanathan Shankar ruled that disseminating extremist content on platforms such as Facebook, WhatsApp and Telegram falls within Section 18’s scope.
  • The National Investigation Agency charged Ahenger under UAPA Sections 17, 18, 18B, 38 and 39 based on digital evidence linking him to TRF and Lashkar-e-Taiba affiliations.
  • Court documents show Ahenger used images and videos of slain terrorist Mehran Yaseen Shalla to glorify attacks and created social media groups aimed at radicalising youth.
  • Ahenger remains in custody ahead of a trial that will test the Delhi High Court’s expanded interpretation of the UAPA in prosecuting online radicalisation.
