Delhi High Court Clears NHAI to Replace Contractor on Stalled Delhi–Mumbai Expressway Stretch

The bench said public interest in restoring traffic flow outweighs the contractor’s objections.

Overview

  • Allowing an NHAI appeal, the division bench authorized steps to terminate RSIIL’s contract for the 35-km Package VIII and to issue a fresh tender or appoint another agency.
  • The court restrained NHAI from encashing RSIIL’s insurance surety bonds and bank guarantees, reported at about Rs 100 crore, until the single-judge matter is decided.
  • The ruling follows NHAI’s December 23, 2025 notice of intent to terminate that a single judge had stayed before the stay was set aside on appeal.
  • Appearing for NHAI, the Solicitor General said unfinished sections are forcing motorists to take detours on newly constructed parts of the corridor.
  • Officials say NHAI is likely to issue cure-period notices for two other RSIIL stretches in Gujarat where progress has lagged.
