Delhi HC Tells DU to File Objections on Delay in Appeals Over Modi Degree RTI Case

The division bench will first consider condonation of delay, with objections due in three weeks followed by a hearing on January 16, 2026.

Overview

  • Appeals by AAP MP Sanjay Singh, RTI activist Neeraj (Neeraj Sharma/Kumar) and advocate Mohd Irshad challenge an August 25, 2024 single-judge ruling that quashed a 2016 CIC disclosure order.
  • Solicitor General Tushar Mehta appeared for Delhi University, opposed issuance of notice, and said he would file a detailed reply and could argue the main matter if required.
  • The court flagged that the appeals were filed late and directed DU to file objections within three weeks, with appellants allowed two weeks to respond.
  • The single judge had held that degrees, marks and related academic records are personal information under Section 8(1)(j) of the RTI Act, citing a fiduciary relationship and no overriding public interest.
  • The CIC in 2016 had allowed inspection of DU’s 1978 BA records, and a similar Gujarat dispute over the PM’s 1983 degree remains on appeal with a hearing slated for January 19, 2026.
