Delhi HC Dismisses Centre's Review in Wankhede Promotion Case, Fines Rs 20,000

The bench faulted the government for concealing a tribunal stay on disciplinary action, directing unsealing of the promotion file for a UPSC decision.

  • A division bench of Justices Navin Chawla and Madhu Jain dismissed the Centre’s review plea and imposed Rs 20,000 in costs, to be deposited with the Delhi High Court Advocates Welfare Fund.
  • The court ordered the Union government to comply within four weeks with the CAT directive to open the sealed cover relating to Sameer Wankhede’s promotion.
  • Under the CAT order, Wankhede is to be granted promotion with effect from January 1, 2021 if the UPSC recommends his name.
  • The bench recorded that no departmental charge-sheet or suspension exists for Wankhede and that no criminal charge-sheet was placed on record.
  • The government had cited CBI and ED registrations and a forged caste-certificate complaint, while the court noted the Centre failed to disclose the CAT’s August 27, 2025 stay on departmental proceedings.
