Delhi HC Demands Transparent Rulebook on Govt Bungalows in Kejriwal Housing Case

The bench set a September 25 hearing requiring a sworn record of the housing policy and prior allotments.

Overview

  • Directing an affidavit, the court asked the Centre to place on record the extant allotment policy, past Type-7 and Type-8 GPRA allocations, and how the rules have been applied.
  • The joint secretary of the housing ministry and the director of the Directorate of Estates must appear virtually on September 25 to answer questions on procedure, priority and discretion.
  • The government informed the court that 35 Lodhi Estate, proposed by AAP for Arvind Kejriwal, was allotted to Union MoS Pankaj Chaudhary on July 24 after the bungalow was vacated in May.
  • Justice Sachin Datta reiterated that residential allotments cannot be based purely on whims and sought clarity on how priority and sequencing are determined when houses are limited.
  • AAP’s petition says Kejriwal qualifies for a government residence under a July 31, 2014 office memorandum, noting letters since April 17, 2023 received no substantive response.
