Delhi Court Quashes Adani Gag Order for Four Journalists, Reserves Ruling on Fifth

The judge said the lower court erred by issuing an ex-parte takedown order without hearing the journalists.

Overview

  • District Judge Ashish Aggarwal set aside the September 6 injunction against Ravi Nair, Abir Dasgupta, Ayaskant Das and Ayush Joshi and sent the matter back for fresh interim consideration.
  • A separate appeal by senior journalist Paranjoy Guha Thakurta was heard by District Judge Sunil Chaudhary, who reserved the order.
  • The lower court had restrained five journalists and three websites from publishing allegedly defamatory material about Adani Enterprises and directed removal of content within five days.
  • Citing that order, the Information and Broadcasting Ministry ordered platforms to remove 138 YouTube links and 83 Instagram posts, including satire and incidental mentions, affecting several people not party to the suit.
  • Journalists argued the injunction was overbroad prior restraint lacking specificity, while Adani Enterprises alleged a coordinated campaign that harmed its reputation and investor confidence.
