Delhi Court Permanently Bars Bengaluru Restaurant From Using ‘Carnatic’ Name

The ruling upholds Carnatic Cafe’s registered trademark after the defendant defaulted on its defence.

Overview

  • District Judge Neelam Singh of the Commercial Court in Saket issued the final order on October 29, 2025.
  • Lemonpepper Hospitality and its associates are permanently restrained from using ‘Carnatic’ or any deceptively similar mark for restaurant or allied services.
  • The court directed transfer of the domain carnaticrestaurant.com to Carnatic Cafe within one month.
  • Damages of Rs 50,000 and costs of Rs 10,000 were awarded to compensate for loss of goodwill and reputation.
  • The court found infringement, passing off and unfair trade practice, noting Carnatic Cafe’s registered rights since 2012, an ex-parte injunction in 2019, and the defendant’s defence being struck off in 2020 under Order VIII Rule 10 CPC.
