December 2025 Visa Bulletin Nudges Employment Cutoffs; USCIS Filing Decision Looms

USCIS will soon decide if applicants can file using the Dates for Filing chart.

Overview

  • The State Department’s December bulletin shows minor forward movement in employment-based Final Action dates, including advances for Rest of World in EB-2 to February 1, 2024 and in EB-3 to April 15, 2023.
  • India’s Final Action cutoffs move to March 15, 2022 for EB-1, May 15, 2013 for EB-2, and September 22, 2013 for EB-3, while China advances to January 22, 2023 for EB-1, June 1, 2021 for EB-2, and April 1, 2021 for EB-3.
  • Dates for Filing remain unchanged from the prior month, and USCIS is expected to announce within about a week whether December I-485 filings may use those dates.
  • A limited EB‑2 to EB‑3 downgrade window opens for select cases: India with priority dates from December 1, 2013 through August 15, 2014 and China with priority dates from December 1, 2021 through January 1, 2022.
  • EB-4 advances to September 1, 2020 with the religious worker program extended through January 29, 2026, and EB-5 unreserved cutoffs move to July 1, 2021 for India and July 15, 2016 for China.
