Crown Will Not Appeal Acquittals in 2018 World Junior Sexual-Assault Case

The decision makes the not-guilty rulings final in criminal court.

Overview

  • Ontario prosecutors notified defence counsel Thursday they will not challenge Justice Maria Carroccia’s July 24 verdicts within the 30-day window.
  • Michael McLeod, Carter Hart, Alex Formenton, Dillon Dubé and Cal Foote were acquitted of charges tied to a June 2018 London hotel incident, and McLeod was also cleared of being party to the offence.
  • In a 91-page decision, the judge found the complainant’s evidence not credible or reliable and concluded the Crown could not meet its burden to disprove lack of consent.
  • The trial ran about eight weeks and shifted to a judge-alone proceeding after a mistrial and the dismissal of a second jury.
  • The NHL says the players remain ineligible during its review, the NHLPA disputes that stance, and separate Hockey Canada disciplinary appeals were paused during the criminal case.
