Courts Tighten Scrutiny of Custodial Deaths: Mumbai Convictions, Supreme Court Rebuke in MP Case

The Mumbai sentences are on hold for appeal as the Supreme Court demands reasons for delayed arrests in the Madhya Pradesh probe.

Overview

  • In Mumbai, a special CBI court convicted ex-PSI Sanjay Khedekar and ex-head constable Raghunath Kolekar for custodial assault, wrongful confinement and causing hurt to extort confession, sentencing them to seven years.
  • The court acquitted both of murder due to conflicting medical opinions on cause of death, accepted that assault occurred in custody, and imposed fines with a portion directed as compensation to the victim’s mother.
  • The prison terms were suspended until November 7 to allow appeals, and the family’s counsel said they will seek enhanced punishment.
  • In the separate Madhya Pradesh case, the CBI informed the Supreme Court that the two accused officers were arrested on September 27 in Indore and October 5 in Shivpuri, with both now lodged in Indore jail.
  • The Supreme Court criticized the delay, sought explanations from the CBI and the state on non-compliance with its May 15 arrest order, asked for details of departmental action, directed limited phone access for a jailed eyewitness, and listed the matter for November 6.
