Court Temporarily Lifts US Sales Ban on Apple Watch Series 9 and Ultra 2

Apple gets a reprieve in its patent fight with Masimo Corp. as it develops a software update to mitigate the issue.

Apple won a court ruling temporarily pausing a US sales ban on its newest smartwatches, the Apple Watch Series 9 and Ultra 2, in a patent fight with medical device maker Masimo Corp.
The US International Trade Commission had blocked the import and sale of these Apple Watch models, finding that Apple infringed a pair of Masimo patents related to measuring blood-oxygen saturation.
Apple has developed a software update for the Apple Watch that it believes will mitigate the issue and has submitted the design of that update to the US customs agency for approval.
Masimo Corp. argues that Apple's hiring of Marcelo Lamego, a former chief technical officer of Cercacor Laboratories Inc., a sister company of Masimo, led to the infringement of its patents.
The court’s ruling allows Apple to resume sales of the two Apple Watch models pending its decision on whether to also permit sales as it weighs Apple’s appeal.
