Court Records Say Kansas Deputy Kneeled on Inmate’s Back for 1 Minute 26 Seconds Before Death

The autopsy ruled Charles Adair’s death a homicide from mechanical asphyxia.

Overview

  • A KBI affidavit describes video showing Deputy Richard Fatherley placing his knee on Charles Adair’s back and shoulder as Adair, handcuffed and prone on a bunk, yelled “help” and then stopped moving.
  • Newly released records specify the pressure lasted 1 minute and 26 seconds before Fatherley exited the cell, after which Adair was found unresponsive and pronounced dead at 9:19 p.m. on July 5.
  • Wyandotte County District Attorney Mark Dupree has charged Fatherley with second-degree murder or, alternatively, involuntary manslaughter, and he is scheduled to appear in court on November 18 by summons.
  • The sheriff’s office has not released the body-camera footage; attorneys Ben Crump and Harry Daniels viewed the video and are demanding public disclosure.
  • The affidavit notes deputies said force should stop once compliance is achieved, yet most recalled their last hands-on defensive tactics training occurred years earlier, while the autopsy also listed chronic health conditions as contributing factors.
