Judges rule the custodial term fits the gravity of the offence following the Solicitor General’s referral under the unduly lenient scheme.

Overview

  • Lady Justice Macur, Mrs Justice Cutts and Mr Justice Murray concluded that the seven-year youth detention term was neither unduly lenient nor manifestly excessive.
  • The defendant was convicted in June for the September 2024 Franklin Park attack that left 80-year-old Bhim Kohli dead after being punched, kicked and racially abused.
  • Solicitor General Lucy Rigby referred the sentence in July under the unduly lenient scheme but the court declined to alter the term.
  • The 13-year-old co-defendant who filmed and encouraged parts of the assault remains on a three-year youth rehabilitation order.
  • The ruling finalises the legal challenge and leaves broader questions over juvenile accountability, community safety and police handling of anti-social behaviour.
