Court of Appeal Lets Palestine Action Challenge Terror Ban, Rejecting Home Office Bid

Judges ruled a High Court review offers a faster, authoritative test of the July proscription than the POAC route.

Overview

  • A panel led by Lady Chief Justice Baroness Carr dismissed the Home Office appeal, allowing co‑founder Huda Ammori’s judicial review to proceed.
  • The High Court has scheduled a three‑day hearing for 25–27 November to examine the lawfulness of the proscription.
  • Judges permitted two additional grounds in the case, including whether the then home secretary failed to consider relevant factors and to follow her own policies.
  • The court said the POAC deproscription process is not designed to challenge the initial ban and that a High Court ruling could guide criminal cases linked to alleged support for the group.
  • Proscription took effect on 5 July, making membership or support a crime punishable by up to 14 years, with more than 2,000 arrests reported and over 100 people charged.
