Court Deadline Arrives for Reinstating Peru’s Prosecutor General Delia Espinoza

The JNJ must execute the order even as it appeals, according to its president.

Overview

  • On October 13, the Ninth Constitutional Court granted a precautionary measure ordering Delia Espinoza’s reinstatement as supreme prosecutor and Prosecutor General within five days of the JNJ being notified.
  • Gino Ríos, president of the JNJ, acknowledged receipt of the court notice and said any appeal by the JNJ’s legal office would be granted without suspensive effect, meaning the ruling must still be carried out.
  • As of Monday morning, interim Prosecutor General Tomás Gálvez said the Public Ministry had not been notified of Espinoza’s return and stated she would be welcomed once notice arrives.
  • Espinoza accused the JNJ of partial treatment for not executing her reinstatement promptly, contrasting it with swift compliance in prior court-ordered returns of Gálvez and Patricia Benavides.
  • Separately, Espinoza called a bill to allow income-tax deductions for extortion payments “absurd,” warning it is unworkable and would burden SUNAT with difficult verification.
