Contran’s New Ciclomotor Rules Take Effect Across Brazil

Legal use now requires registration, plates, annual licensing, ACC or Category A CNH.

Overview

  • Driving without registration or proper habilitation is a gravíssima infraction punishable by a R$293.47 fine, seven CNH points, and vehicle retention.
  • Ciclomotores are defined as two- or three‑wheeled vehicles up to 50 cc or 4 kW with a factory‑limited top speed of 50 km/h, with faster or more powerful models classified as motorcycles or motonetas.
  • State Detrans handle procedures: new units leave dealers with a manufacturer or importer Renavam pre‑registration, while older units without VIN require a CSV issued after inspection by Inmetro‑accredited ITLs.
  • Mandatory safety rules include helmets for rider and passenger and equipment such as a speed limiter, bell, night signaling, a left mirror, and safe tires, with circulation barred on sidewalks, cycle paths, and high‑speed roads unless there is a shoulder or dedicated lane.
  • Fiscal treatment can vary by state, with G1 reporting that Mato Grosso proposes charging a 1% IPVA on ciclomotores.
