Constitutional Court Quashes Move to Unseat Sardinia President Alessandra Todde

The judges said the regional electoral board exceeded its legal remit by ordering decadenza outside the grounds set by law 515/1993.

Overview

  • With decision no. 148, the court found the regional electoral guarantee board overstepped by instructing the council to adopt Todde’s removal following its ordinance-ingiunzione.
  • The alleged campaign finance failings do not correspond to the specific ineligibility scenarios enumerated by law no. 515 of 1993.
  • Todde remains in office, as the route to removal via the board’s ordinance is invalidated by the ruling.
  • The court left any reclassification of the facts to the civil judge, and the Cagliari tribunal on 28 May 2025 upheld the pecuniary sanction against Todde.
  • In decision no. 149, the court declared the Region of Sardinia’s conflict inadmissible, noting the prior judgment bound only Todde and the board and did not constrain the Region.
