Overview
- Ugo Taucer, head of CONI’s Procura generale, refused the FIGC prosecutor’s request to close the file over Giovanni Malagò’s lack of FIGC registration and asked for further clarifications.
- The central legal issue is whether Article 29’s phrase "in regola con il tesseramento" requires a candidate to already be a FIGC tesserato at the time of filing, a point the Procura generale says must be interpreted strictly.
- The FIGC prosecutor Giuseppe Chinè had proposed archiving the case on the view that the statute’s language applies only to persons who already hold a tessera, and he has been asked to answer Taucer’s reservations.
- CONI president Luciano Buonfiglio has been informed and will evaluate the matter with the Giunta scheduled for September 15, while Malagò says he is "serene" and remains in office.
- If CONI or the Procura generale concludes Malagò was ineligible, statutes foresee decadenza with annulment of his acts and the possibility of CONI-appointed commissariamento, outcomes likely to prompt legal challenges and disrupt federation decisions.
