CNJ Forwards R$1.1 Billion in Validated Retroactive Allowances to STF

Overview

• The CNJ sent to the Supreme Court on Friday, August 7 validated retroactive balances of R$1.1 billion linked to the Adicional por Tempo de Serviço after auditing tribunals’ submissions.
• Those validated amounts cover 782 magistrates across four courts: Superior Tribunal de Justiça, Tribunal de Justiça do Distrito Federal, Tribunal de Justiça do Espírito Santo and the TRF-3, with the largest individual claim at R$3.9 million.
• Only four of 63 tribunals that submitted data had calculations deemed valid by the CNJ, while 58 courts produced inapt spreadsheets mostly for using a calculation base different from CNJ rules and must correct and resubmit their files.
• Any payments still require STF authorization and will be constrained by the court’s March decision capping penduricalhos at 35% of the public pay ceiling, which means large balances will be paid in installments over many years.
• The R$1.1 billion covers only ATS (the five‑year service increment known as quinquênio) and does not represent the full national liability, so the CNJ audit process and tribunal corrections will determine the wider fiscal impact.
