Overview

  • The Crown argued that two videos Michael McLeod filmed in the Delta Armouries hotel room amounted to coerced “box checking” rather than valid proof of consent.
  • Defense lawyers maintained that the complainant, E.M., voluntarily engaged in sexual activity with McLeod and his teammates and that Cal Foote did not touch her.
  • E.M. testified she was heavily intoxicated after initial consensual sex with McLeod and felt pressured and unsafe when other players joined without her clear agreement.
  • The proceeding featured disputed memory gaps, intense cross-examinations, excluded evidence and a shift to a judge-only format after two juries were dismissed.
  • Following closing submissions, Justice Carroccia is scheduled to hand down her ruling on July 24 in the trial that began in April.
