CIC Rules BCCI Not a Public Authority Under RTI Act

Citing the board’s private status, the order signals that any transparency mandate would require legislation.

Overview

  • The Central Information Commission, which ruled Monday, said the BCCI does not fall under the RTI Act and is not bound to release records through public information requests.
  • That decision reverses a 2018 CIC order after the Madras High Court in September 2025 sent the matter back for a fresh look in light of Supreme Court observations.
  • The Commission found the BCCI is a private society registered in Tamil Nadu, faces no deep or pervasive government control, and runs on its own revenues from media rights, sponsorships, and ticket sales.
  • The order states that tax breaks or access to public facilities do not count as substantial government financing and notes that bringing the BCCI under RTI would need a new law or a specific government directive.
  • The case arose from a 2017 RTI seeking the legal basis for BCCI’s role in picking India’s team and running tournaments, which the Sports Ministry said it did not hold, and the CIC dismissed the appeal.
