Emilie Kiser's attorney, Kevin O'Malley, heads back to his seat after presenting to Judge Christopher Whitten during a hearing at the Maricopa County Superior Court in Phoenix, on June 3, 2025.

Overview

  • On July 15, the Chandler Police Department recommended that Trigg Kiser’s father be charged with a Class 4 felony count of child abuse, which carries up to three years in prison for criminal negligence.
  • Investigators concluded that Brady Kiser lost sight of his son for three to five minutes while caring for the couple’s newborn before finding him floating in the family’s backyard pool.
  • The Maricopa County Attorney’s Office is reviewing the police referral and will determine whether to prosecute, request further investigation or dismiss the case.
  • In late May Emilie Kiser filed suit to keep police reports and autopsy files private, and a June court order temporarily bars their release pending a final ruling.
  • Arizona law requires safety barriers around home pools and drowning remains the leading cause of death for children ages 1 to 4 in the United States.
