CDMX Sends Rent Law to Congress Capping Increases at Inflation

The proposal seeks to restrain rising housing costs by requiring contract registration, creating a tenant defender office, imposing fines for overcharges, and offering social support before evictions.

Overview

  • The city government sent the Ley de Relaciones Inquilinarias y Rentas Justas, Razonables y Asequibles to the Congress of Mexico City on Thursday and it now awaits committee review and a possible floor vote.
  • The draft would limit annual rent hikes so they cannot exceed the prior year’s INEGI inflation figure and allows higher increases only if landlords prove substantive improvements.
  • A mandatory digital Registry of Rental Contracts run by the Agencia Digital de Innovación Pública would require landlords to register contracts and deliver an official constancia to tenants within set deadlines.
  • The bill creates a Defensoría adscrita to the Procuraduría Social to provide free legal advice, verify compliance and impose fines expressed in UMA or months of rent for violations.
  • It also sets a minimum one-year lease, rules on deposits and prohibited pass-through costs, and establishes a Gabinete de Acompañamiento Social to identify vulnerable households and seek mediation before judicial evictions.
