CCPA Orders E-Commerce Platforms to Self-Audit and Eliminate Dark Patterns

Firms have three months for self-audits under the watch of a joint working group, with potential penalties under the Consumer Protection Act upon non-compliance.

Overview

  • The Central Consumer Protection Authority issued an advisory on June 7 requiring all e-commerce platforms to audit their interfaces and remove 13 identified dark patterns.
  • Platforms are encouraged to submit self-declarations confirming their sites are free of deceptive design practices after completing the audits.
  • A Joint Working Group comprising ministries, regulators, consumer organisations and national law universities will monitor violations and recommend public awareness programmes.
  • The government rolled out three tech tools developed with IIT-BHU—Jagriti App, Jago Grahak Jago App and Jagriti Dashboard—to help users detect and report manipulative interface tactics.
  • E-commerce firms that fail to comply risk fines or imprisonment under the Consumer Protection Act, 2019.
