CCI, MeitY Set Regular Consultations on Data Protection–Competition Overlap

The step signals an effort to clarify roles in policing data-driven market power during the pause on a new digital competition law.

Overview

  • On August 28 in New Delhi, CCI chairperson Ravneet Kaur met MeitY secretary S. Krishnan to discuss the Digital Personal Data Protection Act and its interface with competition law.
  • Officials from both institutions exchanged presentations on the DPDPA, the Competition Act, and the CCI’s work in digital markets, and resolved to keep up regular consultations.
  • The CCI said closer coordination can support consumer welfare and innovation as data concentration creates risks for privacy and competition.
  • On August 19, the Ministry of Corporate Affairs said it will conduct market studies to build an evidence base before deciding on any ex-ante digital competition regime.
  • Parliamentary scrutiny and the CCI’s 2024 fine on Meta over WhatsApp’s data-sharing illustrate unresolved overlap between privacy enforcement and antitrust rules.
