CCI Directs UltraTech, Dalmia Bharat and Shree Digvijay to Submit Financial Records

The order follows a DG report that flagged alleged bid-rigging in ONGC tenders between 2013 and 2018

Overview

  • The CCI has given UltraTech an eight-week deadline to submit five years of audited statements for India Cements and asked Dalmia Bharat and Shree Digvijay to provide nine years of records.
  • The regulator warned that failure to furnish or providing incomplete or false information will incur penalties under section 45 of the Competition Act.
  • UltraTech Cement told stock exchanges it has not received any CCI order in this case and called reports of an investigation “false and misleading.”
  • India Cements said it is yet to receive the full CCI investigation report and that no findings or penalties have been imposed against it at this stage.
  • UltraTech’s Chief Legal Officer Anoop Khatry resigned effective July 3, citing personal reasons as the companies prepare their formal responses to the probe.
