Overview
- U.S. Customs and Border Protection and Treasury have started sending ACH refunds through the CAPE portal after the Supreme Court voided the IEEPA tariffs.
- The program covers about $166 billion spread over 53 million entries paid by more than 330,000 importers.
- CBP reported by late April that roughly 21% of affected entries were accepted for duty removal and about 3% had reached the refund stage, with about 15% of filings rejected for errors or ineligible shipments.
- Businesses will receive the money rather than shoppers, though UPS, FedEx, and DHL say they will reimburse customers for packages charged the unlawful duties.
- In a separate case, the Court of International Trade struck down the newer 10% tariffs under Section 122 for the suing importers and ordered refunds with interest, and the administration may appeal.
