CBI Opposes Retrial Bid by Three Convicted Union Carbide Officials in Bhopal Case

The agency says the Section 464 plea lacks legal basis without proof of prejudice arising from the original proceedings.

Overview

  • The CBI filed written and oral submissions on Monday before Principal District and Sessions Judge Manoj Kumar Shrivastava in Bhopal opposing the retrial request.
  • The plea, pending since 2011, was filed by Kishore Kamdar, J. Mukund and S. P. Chowdhury seeking a rehearing of the June 7, 2010 conviction.
  • The CBI argues the application is not maintainable unless the convicts demonstrate specific prejudice during investigation or trial and contends that acquitting the guilty would be a failure of justice.
  • Citing the Supreme Court’s 1996 order and the trial court’s 1997 framing of charges, the agency notes the accused did not contest the charges during the proceedings and says they had pleaded guilty to the charges voluntarily.
  • Victims’ group BGIA submitted written arguments urging dismissal of the plea, and the matter is scheduled to be heard next on October 6.
