Cassation Court Declines January Review of Kirchner’s House-Arrest Appeals

Judges said the case did not meet the urgency threshold for recess proceedings.

Overview

  • The Federal Cassation Chamber refused to open the judicial recess to hear Cristina Fernández de Kirchner’s challenges to her detention conditions, leaving the measures in force until February.
  • The feria panel split 2–1, with Ángela Ledesma and Guillermo Yacobucci finding no urgency under Acordada 7/2009 and Mariano Borinsky dissenting.
  • The disputed orders limit visits to three people for up to two hours twice a week, require prior authorization for those not on an approved list, cap terrace use at two hours daily, and keep electronic monitoring.
  • Judge Jorge Gorini of TOF2 imposed the tighter rules after a photo showed nine economists visiting her home in a single, unnotified meeting.
  • The appeals will move to Sala IV when regular activity resumes in February, and the defense still has the option to seek extraordinary review by the Supreme Court.
