CAS Rejects Uhlaender Olympic Appeal on Jurisdiction Grounds

The court said the dispute fell outside its 10-day Games window, leaving the U.S. skeleton lineup unchanged.

Overview

  • CAS’s Milan-Cortina ad hoc division ruled it can only hear disputes arising during the Games or within 10 days before the Feb. 6 opening, placing the Jan. 11 race and Jan. 23 IBSF ruling outside its remit.
  • The decision means five-time Olympian Katie Uhlaender will not be added to Team USA, with Kelly Curtis and Mystique Ro set to compete in women’s skeleton.
  • Uhlaender argued Canada’s late withdrawals at a Lake Placid North American Cup event reduced the field and ranking points; Bobsleigh Canada Skeleton cited athlete welfare and was cleared by the IBSF Integrity Unit.
  • An IBSF appeals tribunal concluded the Canadian action was intended to reduce available points but did not re-award points and the IOC had already declined a discretionary place.
  • CAS issued a similar out-of-jurisdiction decision in an Irish luge appeal, underscoring the narrow scope of Olympic ad hoc arbitration for pre-Games qualification disputes.
