Carfagna To File Italian Bill Targeting Deepfakes and Online Image Theft

The initiative answers a surge of sexist deepfakes with new obligations for platforms, users, AI providers.

Overview

  • Deputy Mara Carfagna said she will deposit the bill in the Chamber in the coming days after cases linked to sexist forums such as Phica.eu.
  • The draft defines deepfakes across manipulated images, audio or video that can appear falsely authentic, makes the offense prosecutable ex officio when minors are involved or the intent is discriminatory, and carves out a narrow satire exception that does not harm dignity, reputation or safety.
  • Any generated or shared deepfake would have to carry a visible watermark, and AI system providers would have to retain related logs for at least 12 months.
  • Digital platforms would be required to verify user identities via SPID, CIE or eIDAS, receive reports and remove illicit content promptly, comply with takedown orders, and provide logs and technical data to judicial authorities.
  • Oversight would be assigned to the Data Protection Authority with the innovation department and AGCOM, with powers for inspections and audits, and noncompliance could trigger fines of €10,000–€100,000, suspension of activities in Italy, or prison terms of one to five years for managers who refuse to hand over requested data.
