Capitol Rioter Sentenced to Three Months in Jail

Frank Rocco Giustino, who berated a judge and insulted a prosecutor, will remain in custody for approximately two more months.

Frank Rocco Giustino, a New York massage therapist, has been sentenced to three months in jail for his involvement in the January 6, 2021, Capitol riot.
Giustino pleaded guilty in February to a misdemeanor charge related to the riot, but was arrested last month after failing to appear in court for an earlier sentencing hearing.
During his court proceedings, Giustino skipped hearings, insulted a prosecutor, and berated the judge, leading to an increase in his recommended sentence from 21 days to four months.
Giustino was arrested in Florida in October after failing to appear in court twice after his guilty plea.
Before the riot, Giustino frequently posted on Facebook about conspiracy theories that the 2020 presidential election was stolen from Trump.
