California to Ban 'Particularly Harmful' Ultra-Processed Foods From School Meals by 2035

Schools will begin phasing out qualifying items in 2029 under a first-of-its-kind state law.

Overview

  • Gov. Gavin Newsom signed AB 1264, directing the state to define which ultra-processed foods are 'particularly harmful' by 2028 and setting a timeline to remove them from school breakfasts and lunches.
  • Soda, energy drinks and other high-sugar or high-salt, additive-heavy items are expected to be swept from menus as definitions are finalized and implementation begins.
  • Ultra-processed products account for about 53% of adults’ and 62% of children’s calories in the U.S., federal data show.
  • A randomized crossover trial from the University of Copenhagen reported rapid fat gain, elevated phthalate biomarkers and declines in testosterone and sperm production in healthy men on a UPF-heavy diet despite matched calories and nutrients.
  • Experts note the trial’s short, small, male-only design and emphasize that UPFs are heterogeneous, urging clearer definitions and guidance that prioritize overall diet quality.
