Bronx Shooting Suspect Dies in Rikers Custody as DOC Opens Probe

Oversight reviews are underway following a Department of Correction investigation.

  • The Department of Correction said Jimmy Avila was pronounced dead at 4:29 p.m. Saturday at Rikers Island’s West Facility after a medical emergency, with the cause pending from the medical examiner.
  • Avila had been charged with murder, attempted murder and weapons possession in the killing of building superintendent Ryan Hines, 37, and the wounding of two men during an Aug. 27 shooting in the Bronx.
  • Correction officials said they notified the federal monitor, the Board of Correction, the state attorney general’s office, the city Department of Investigation, the state Commission of Correction, the Office of Chief Medical Examiner and local district attorneys.
  • The death is being counted as New York City’s 11th in-custody fatality this year and the second reported at Rikers within a week.
  • The Legal Aid Society criticized how defense counsel were informed, and officials listed conflicting ages for Avila in public records.
