Brazil’s Lower House Votes to Suspend Guidance on Abortion Access for Child Rape Survivors

The measure now heads to the Senate after an expedited vote that opponents say will create a protection vacuum for girls and adolescents seeking legal care.

  • By a 317–111 vote, the Chamber of Deputies approved PDL-03/2025 to suspend Conanda’s 2024 Resolution 258, which set national guidelines for humanized access to legal abortion for minors who are victims of sexual violence.
  • Lawmakers first approved fast-track consideration 313–119, allowing the proposal to bypass committees and go straight to the floor.
  • The contested resolution detailed procedures for cases already allowed by law and dispensed with police reports, judicial authorization or parental consent when these would endanger or obstruct the victim, and it advised against using gestational limits as a barrier.
  • The proposal was authored by Chris Tonietto (PL-RJ) with a favorable report from Luiz Gastão (PSD-CE), backed by evangelical and Catholic parliamentary fronts, while government-aligned and progressive parties opposed.
  • The Ministry of Women and the National Human Rights Council warned the suspension will hinder access to care, citing over 232,000 births to mothers up to 14 years old from 2013–2023 and only 154 girls obtaining legal abortion in 2023.
