Brazil’s Lower House Moves to Fast-Track Bill Ensuring Free Carry-On Bags

Lawmakers seek to cement a passenger right after airlines launched Basic fares that exclude cabin luggage on short international routes.

Overview

  • Hugo Motta said he will put the urgency request for PL 5041/2025 on the agenda next week, calling carry-on charges an abuse and pledging to prioritize consumers.
  • The Da Vitória bill guarantees one carry-on and one personal item at no extra cost on flights operating in Brazil, forbids fare classes that remove this right, and sets penalties including double refunds and fines reportedly up to 200 times the improper charge.
  • Gol began selling a Basic fare on Oct. 14 that allows only a personal item up to 10 kg (32 x 22 x 43 cm), available this year on routes originating outside Brazil and on the Rio de Janeiro (Galeão)–Montevideo service, with previously issued tickets keeping prior baggage rights.
  • Latam has offered a similar Basic option since 2024 on short international routes to Argentina, Chile, Paraguay, Uruguay, and Peru, limiting travelers to a single personal item of up to 10 kg (45 x 35 x 20 cm).
  • ANAC rules still guarantee one 10 kg hand bag on domestic flights regardless of fare, while Procon-SP requested explanations from airlines and raised concerns about clarity of information and potential safety impacts from increased under-seat stowage.
