Brazil’s Lower House Approves Tougher Penalties for Sexual Crimes Against Vulnerable Victims

The bill returns to the Senate for a new vote before any presidential decision.

  • In a symbolic vote on Oct. 15, the Chamber approved a substitute text authored in the Senate by Margareth Buzetti and reported by Deputy Delegada Katarina that stiffens sentences for offenses including lewd acts with minors, sexual exploitation, and distribution of assault imagery.
  • Judges could immediately apply protective measures from the Maria da Penha law when there are indications of sexual crimes or when victims are children, adolescents, people with disabilities, or elderly persons.
  • Breaching emergency protective orders is added to the Penal Code with a penalty of two to five years in prison and a fine.
  • Convicted offenders who receive authorized prison exits must wear electronic ankle monitors to allow monitoring during temporary leave.
  • The text also addresses online abuse by requiring tech companies to remove notified content that violates children’s rights and to maintain a legal representative in Brazil, while expanding victim and family support in child and disability statutes.
