Brazil Year-End Prison Furloughs: 46,000 Released, About 1,900 Did Not Return

New restrictions face constitutional non-retroactivity, delaying any immediate change to who qualifies for the benefit.

Overview

  • Data compiled by g1 from 15 states and the Federal District indicate roughly 4% of those granted the seven-day leave failed to return, with totals remaining provisional as Paraná, Rondônia and Minas Gerais have not provided complete figures.
  • São Paulo recorded the largest absolute number of fugitives, with 1,131 not returning out of 29,200 people released.
  • Rio de Janeiro posted the highest non-return rate at about 14%, with 269 fugitives, including individuals linked to criminal factions.
  • Eight states reported not granting year-end temporary leave: Acre, Alagoas, Amazonas, Goiás, Mato Grosso, Paraíba, Pernambuco and Rio Grande do Norte.
  • Congress overturned President Lula’s veto of a law restricting furloughs, but legal experts say the change generally applies only to sentences after enactment, limiting near-term effects on eligibility.
