Brazil Tightens Rules on FGTS Birthday‑Withdrawal Advances

Officials aim to curb predatory credit, preserving FGTS resources for housing and infrastructure.

Overview

  • The FGTS Council approved the restrictions on Oct. 7, with enforcement to begin once Caixa updates systems by Nov. 1.
  • Each advance is capped at R$100–R$500 per parcel, with up to five parcels in a one‑year transition (maximum R$2,500) and three parcels thereafter.
  • Only one anticipation contract will be allowed per year, and banks must wait 90 days after a worker opts into the birthday withdrawal to offer the credit.
  • The government estimates R$84.6–R$86 billion will remain in workers’ FGTS accounts through 2030, supporting financing for housing, sanitation and infrastructure.
  • The measure targets the bank‑credit anticipation mechanism; the birthday‑withdrawal option remains, with 21.5 million enrolled and about R$102.9 billion already advanced.
