Brazil Supreme Court Panel Rejects Bolsonaro’s Final Appeal, Clearing Way for 27-Year Sentence

The First Chamber’s unanimous rejection leaves a short window for any vote changes before justices set where and under what conditions he will serve time.

Overview

  • Four participating justices — Alexandre de Moraes, Flávio Dino, Cristiano Zanin and Cármen Lúcia — unanimously denied Jair Bolsonaro’s clarification appeals, effectively upholding his 27 years and 3 months sentence.
  • The decision remains procedurally open until November 14 for any change of vote, after which the court is expected to define his place of custody and enforcement regime.
  • Justice Luiz Fux, who had previously accepted parts of the defense’s arguments, is no longer on the First Chamber and did not take part in this stage.
  • The First Chamber also rejected appeals from several co-defendants, including former defense and justice ministers and former senior military officials tied to the conspiracy case.
  • Bolsonaro has been under preventive house arrest since August in a separate case, and his lawyers are expected to seek permission for him to serve the sentence at home on health grounds.
