Brazil Sets Rules for Pension for Children of Feminicide Victims, Applications Start Dec. 1

The new decree operationalizes a one–minimum wage benefit restricted to low‑income minors and routed through the INSS.

Overview

  • The federal decree (No. 12,636/2025), published Sept. 30, implements Law 14,717/2023 and creates a special pension for minors orphaned by feminicide.
  • The benefit pays one minimum wage per month, ends at age 18, cannot be combined with most social security or military pensions, and lacks a 13th payment.
  • Eligibility requires per‑capita family income at or below 25% of the minimum wage and CadÚnico registration updated every 24 months, with inclusion of children of transgender women and minors under state guardianship.
  • Applications will be received and decided by the INSS starting Dec. 1, 2025, with payment due from the request date and documentation to prove feminicide such as an arrest report, inquiry order, prosecutor’s complaint, or judicial decision.
  • A federal court in Rio Grande do Sul granted the pension to four siblings in a 2015 case and ordered retroactive pay from November 2024, diverging from the decree’s non‑retroactivity rule.
