Brazil Enacts Law Toughening Penalties for Providing Alcohol or Addictive Substances to Minors

The statute takes immediate effect, triggering harsher sentences when the minor actually consumes the substance.

Overview

  • President Luiz Inácio Lula da Silva sanctioned Law No. 15.234/2025, published on Oct. 8 in the Diário Oficial da União, putting it into force immediately.
  • The measure amends Article 243 of the Child and Adolescent Statute to allow a sentence increase of one-third to one-half when consumption by the minor occurs.
  • The rule applies to anyone who sells, serves, delivers or otherwise provides alcohol or other dependence‑causing products, including when provided free of charge.
  • Judges are instructed to consider the intensity of harm in sentencing, while the ECA’s existing framework of two to four years of detention and a fine remains in place.
  • Coverage attributes the legislative origin differently, with Congress em Foco citing PL 942/2024 by Deputy Laura Carneiro and Poder360 citing a proposal by Senator Damares Alves approved in a Senate human rights commission on July 16.
