Brandenburg Expands Rent Cap to 36 Municipalities, Drops Five From 2026

A building-code revision now moves to cabinet on December 16.

Overview

  • The state will extend the Mietpreisbremse to 36 municipalities next year and remove Neuenhagen, Hohen Neuendorf, Schöneiche, Hoppegarten and Gosen‑Neu Zittau.
  • New leases may be set at no more than 10% above the local comparative rent, and existing rents may rise by a maximum of 15% over three years.
  • The ordinance applies only to homes completed before 2014, leaving new builds outside the cap.
  • An independent expert report assessing vacancy and demand determined where rent limits will apply and where they will lapse.
  • The CDU criticized the move as insufficient without more homebuilding, while the government targets a Landtag decision on building-code changes in the first half of 2026.
