Boston Medical Center ER Rape Suspect Pleads Not Guilty, Held Without Bail

The judge cited the patient’s paralysis in finding him dangerous.

Overview

  • Barry Howze, 55, was arraigned Jan. 5 in Suffolk Superior Court after a Dec. 12 grand jury indictment.
  • He faces two counts of rape, indecent assault and battery on a person over 14, assault and battery on a person with a disability, and witness intimidation.
  • Prosecutors say the assault occurred late Sept. 13 into Sept. 14 in a curtained emergency-room bay at Boston Medical Center.
  • According to the judge’s findings, he entered the bay, crept under the bed, and removed the call button before the alleged assault.
  • Court records state he has a schizophrenia diagnosis and was under a Section 12 psychiatric hold; he is due back in court Feb. 26, and prosecutors say he later left the hospital and returned under a false name before being taken into custody.
