Bombay High Court Upholds SBI's Fraud Tag on Anil Ambani, RCom Accounts

The ruling upholds SBI's June fraud classification under RBI guidelines.

Overview

  • A division bench of Justices Revati Mohite Dere and Neela K Gokhale dismissed Anil Ambani's writ petition, stating it lacked merit.
  • SBI alleged misappropriation leading to a Rs 2,929.05 crore loss, after which the CBI registered a case and searched RCom-linked premises and Ambani's residence.
  • Ambani argued that SBI violated principles of natural justice by denying a personal hearing and by providing key documents only after months.
  • Under RBI’s fraud reporting framework, such classifications are reported to the regulator and investigative agencies, while RCom continues under insolvency at the NCLT.
  • Other lenders have taken or reviewed similar steps, with Canara Bank withdrawing a 2024 fraud order and a court granting Ambani temporary relief against Bank of Baroda in a separate matter.
